"Service" refers to the artificial intelligence consulting services offered by Qubic Mind, including predictive analytics platform setup, conversational AI design, and data readiness assessments. "User" or "You" refers to any individual or organization accessing our website or engaging our services. "We," "Us," or "Our" refers to Qubic Mind, located at 42/7 Ratchadaphisek Road, Chatuchak, Bangkok 10900, Thailand. "Agreement" refers to these Terms and Conditions together with any separate service agreement signed between the parties. "Content" means text, data, images, and other materials available on our website or delivered as part of a service engagement.
2. Acceptance of Terms
By accessing our website or engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. 3. Service Description
Qubic Mind provides AI consulting services to organizations in Thailand and the broader Southeast Asian region. Our services include predictive analytics platform setup, conversational AI design, and data readiness assessments. The specific scope, deliverables, and timeline for each engagement are defined in a separate service agreement or proposal document provided before work begins.
Service availability is subject to our capacity and scheduling. We reserve the right to decline or defer engagements based on current workload.
4. User Responsibilities
When using our website, you agree to use it only for lawful purposes and in a manner that does not infringe upon the rights of others. You agree not to attempt to gain unauthorized access to any part of our website, systems, or data. You agree not to use our website to transmit harmful content such as malware, spam, or deceptive material. You agree not to reproduce, distribute, or modify content from our website without written permission.
When engaging our services, you agree to provide accurate and timely information needed for project execution, to designate an authorized point of contact for communications, and to comply with any data access or security protocols we establish for the engagement.
5. Intellectual Property
All content on our website — including text, design, logos, and graphics — is the intellectual property of Qubic Mind and is protected by Thai and international copyright laws. You are granted a limited, non-exclusive, non-transferable license to access and view our website for personal or business evaluation purposes. For service engagements, intellectual property ownership of deliverables will be specified in the service agreement. Typically, clients receive full ownership of custom-built solutions upon completion and final payment, while Qubic Mind retains ownership of its proprietary methodologies and tools.
6. Payment Terms
Pricing for each service is communicated in writing before an engagement begins. All prices are quoted in Thai Baht (฿) unless otherwise specified. Payment schedules are defined in the service agreement — typically structured as an initial deposit followed by milestone-based payments. Late payments may incur a reasonable administrative charge as specified in the agreement. We accept bank transfers and other payment methods as agreed upon with the client.
Refund eligibility depends on the specific terms of the service agreement and the stage of project completion at the time of cancellation.
7. Service-Specific Terms
Predictive Analytics Platform Setup: Delivery timelines are estimates and may vary based on data complexity. The client is responsible for providing access to relevant data sources. The prototype dashboard is delivered as a working version; further customization beyond the agreed scope may require a separate engagement.
Conversational AI Design: The client is responsible for providing sample conversations, historical inquiry data, and feedback during the testing phase. Post-launch monitoring is included for the duration specified in the service agreement.
Data Readiness Assessment: The assessment is based on information and access provided by the client. The final report and improvement plan represent our professional recommendations and should be interpreted as guidance rather than directives.
8. Disclaimers
Our services are provided on an "as is" basis. While we strive to deliver high-quality, useful outcomes, we do not make representations or warranties regarding specific business results from the use of our services. AI models, predictions, and recommendations are inherently probabilistic and should be considered as one input among many in business decision-making. We are not liable for decisions made based on our deliverables.
9. Limitation of Liability
To the maximum extent permitted by Thai law, Qubic Mind's total liability for any claim arising from our services shall not exceed the total fees paid by the client for the specific engagement in question. We shall not be liable for indirect, incidental, consequential, or punitive damages, including lost profits, data loss, or business interruption. This limitation applies regardless of the legal theory under which liability is sought.
10. Indemnification
You agree to indemnify and hold harmless Qubic Mind, its team members, and affiliates from any claims, losses, damages, liabilities, and expenses arising out of your use of our website, breach of these terms, or violation of any third-party rights.
11. Termination
Either party may terminate a service engagement according to the terms specified in the service agreement. Upon termination, the client is responsible for payment for all work completed up to the termination date. We may suspend or restrict access to our website if we reasonably believe these terms are being violated. Sections relating to intellectual property, limitation of liability, and indemnification survive termination.
12. Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Kingdom of Thailand. Any disputes arising from these terms or our services shall first be addressed through good-faith negotiation between the parties. If a dispute cannot be resolved through negotiation within 30 days, either party may submit the matter to the courts of competent jurisdiction in Bangkok, Thailand.
13. General Provisions
These Terms and Conditions, together with any applicable service agreement, constitute the entire agreement between you and Qubic Mind. If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force. Our failure to exercise any right under these terms does not constitute a waiver of that right. We may assign our obligations under these terms to a successor entity in the event of a business transfer.

We may update these Terms and Conditions periodically. When changes are made, we will update the "Last Updated" date at the top of this page. Continued use of our website or services after changes have been posted constitutes acceptance of the revised terms. We encourage you to review this page periodically.
